1. ACCEPTANCE OF TERMS

By using this website, registering for classes, enrolling in programs, attending events, or participating in Miami Fencing Club activities, you agree to these Terms and Conditions.

For minors, registration and participation must be completed, approved, and signed by a parent or legal guardian.

2. SERVICES

Miami Fencing Club provides Olympic fencing instruction, group classes, private lessons, training programs, open fencing, events, competitions, merchandise, and related services.

All services are subject to availability, scheduling, safety requirements, coach assignment, and Club policies.

3. ELIGIBILITY

Participation is open to individuals ages 7 and older, unless otherwise approved by Miami Fencing Club.

Minors must be registered by a parent or legal guardian.

4. USA FENCING AND EQUIPMENT REQUIREMENTS

Athletes may be required to maintain an active USA Fencing membership as a condition of participation.

Participants must arrive prepared with proper fencing equipment, protective gear, and appropriate footwear. Miami Fencing Club may deny participation if a student is not properly registered, equipped, or prepared to participate safely.

5. MEDICAL FITNESS AND ASSUMPTION OF RISK

Participants must be physically able to participate in fencing and related athletic activities.

Fencing is a structured Olympic sport with safety rules and protective equipment, but athletic activity involves inherent risks. By participating, adult participants and parents or legal guardians of minors accept responsibility for determining whether the participant is medically and physically able to participate.

6. REGISTRATION DATA ONLY

Miami Fencing Club collects only the information reasonably necessary for registration, participation, safety, communication, scheduling, emergency contact, payment records, and Club administration.

This information is provided by the adult participant or by the parent or legal guardian during the registration process.

Miami Fencing Club does not sell personal information and does not request unnecessary personal data.

7. PAYMENTS

Registration fees, class fees, monthly training fees, private lesson fees, event fees, merchandise purchases, and other charges must be paid in advance unless otherwise approved in writing.

Fees are non-refundable and non-transferable unless otherwise stated in writing by Miami Fencing Club or required by law.

8. CANCELLATION POLICY

A minimum of 30 days’ written notice is required to cancel any program, monthly plan, or ongoing participation arrangement.

Missed classes, absences, vacations, illness, late arrivals, or schedule conflicts are not refunded and are not automatically rescheduled.

9. PRIVATE LESSONS

Private lessons are subject to availability, scheduling approval, coach availability, and payment confirmation.

Private lessons canceled with less than 24 hours’ written notice may be forfeited.

10. STUDENTS AND COACHES

Students enrolled in Miami Fencing Club are part of the Club’s institutional program and do not belong to any individual coach, volunteer, assistant, member, family, or third party.

Coach assignments, groups, schedules, classes, levels, activities, and training structure are determined by Miami Fencing Club according to safety, athletic, technical, administrative, and operational criteria.

11. CONDUCT AND GOOD FAITH

Students, parents, families, coaches, volunteers, visitors, vendors, members, and third parties must act respectfully, safely, and in good faith.

Rumors, malicious comments, harassment, bullying, retaliation, public pressure, defamation, manipulation of families, creation of divisions, interference with coaches or students, or any conduct that disrupts the Club’s athletic environment is not permitted.

Miami Fencing Club may restrict access, suspend participation, remove a person from an activity, terminate membership, deny future registration, or take other appropriate action when necessary to protect students, families, coaches, staff, reputation, safety, privacy, discipline, or Club operations.

12. OFFICIAL COMMUNICATION AND WRITTEN DOCUMENTATION

All official requests, complaints, cancellations, refund requests, schedule changes, authorizations, incident reports, document requests, administrative matters, or legal communications must be submitted in writing.

Phone calls, voice messages, casual conversations, social media messages, public comments, hallway conversations, or undocumented verbal statements do not constitute official notice, authorization, approval, complaint, cancellation, or instruction unless confirmed in writing by Miami Fencing Club.

13. PUBLIC COMMUNICATIONS AND SOCIAL MEDIA

Miami Fencing Club respects freedom of expression and does not prevent any person from reporting a real emergency, safety concern, abuse, unlawful conduct, or legitimate matter to proper authorities.

However, social media, public comments, online reviews, stories, group messages, or digital campaigns must not be used to pressure, harass, defame, expose private information, spread rumors, attack individuals, divide the team, or interfere with the Club’s operation.

Concerns must be handled privately, respectfully, and through official written communication channels.

14. MEDIA RELEASE

By completing registration, accepting participation terms, or authorizing a minor’s participation, the adult participant or parent/legal guardian authorizes the reasonable use of photographs, videos, recordings, or images taken during classes, training sessions, competitions, events, ceremonies, Club publications, website content, official social media, and Club communications.

This authorization is limited to legitimate Club purposes, including athletic promotion, education, institutional communication, recognition of achievements, event participation, and community development.

If a parent or legal guardian does not authorize use of a minor’s image, written notice must be submitted before participation or at the time of registration. Any later revocation must be submitted in writing and applies only going forward.

15. INTELLECTUAL PROPERTY AND DIGITAL ASSETS

All website content, logos, names, images, videos, designs, documents, social media accounts, domains, emails, platforms, passwords, administrative access, and digital assets created, used, or managed for Miami Fencing Club belong to or remain under the control of Miami Fencing Club unless a written agreement states otherwise.

No person may retain, block, delete, transfer, misuse, or withhold Club accounts, passwords, documents, files, access credentials, or digital assets.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Miami Fencing Club is not liable for indirect, incidental, consequential, punitive, or special damages arising from participation in Club activities, use of the website, events, services, or third-party platforms.

Nothing in these Terms waives rights that cannot be waived under applicable law.

17. PERSONAL PROPERTY

Miami Fencing Club is not responsible for lost, stolen, misplaced, abandoned, or damaged personal belongings, including fencing equipment, clothing, bags, electronics, or valuables.

18. THIRD-PARTY SERVICES

Miami Fencing Club may use third-party services, including payment processors, booking tools, registration platforms, website providers, email systems, social media platforms, and competition platforms.

Miami Fencing Club is not responsible for the independent policies, fees, errors, outages, data handling, or actions of third-party providers.

19. GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Florida.

20. MODIFICATIONS

Miami Fencing Club may update these Terms and Conditions at any time. Continued use of the website, registration for classes, participation in activities, or communication with the Club constitutes acceptance of the updated Terms.

22. HUMAN REVIEW REQUIRED

These Terms and Conditions must be interpreted in good faith to protect the safety, privacy, reputation, students, families, coaches, staff, volunteers, assets, and institutional community of Miami Fencing Club.

By completing a payment, you declare that you have read, understood, and accepted all applicable waivers, policies, rules, regulations, and participation requirements of Miami Fencing Club.
